As a Senior Legal Counsel, Market Regulation Germany & Austria, you'll play a critical role in shaping our regulatory strategy and ensuring compliance with laws and regulations in Germany and Austria.

Key Responsibilities:

  • Provide comprehensive legal advice and support to our businesses in Germany and Austria, ensuring regulatory compliance and effective risk management.
  • Collaborate with our senior management and support functions to identify and mitigate legal risks, ensuring the integrity of our operations.
  • Monitor legislative developments at the domestic and international level, providing ongoing legal support and guidance on European and local legislation.
  • Develop and implement effective regulatory strategies, ensuring alignment with our business objectives and compliance with applicable laws.
  • Manage complex legal customer complaints and litigation in Germany and Austria, working closely with our external counsel and internal stakeholders.
  • Report significant regulatory, financial, or brand risks to management and our VP/Group Counsel, ensuring timely and effective mitigation.
  • Build and maintain strong relationships with local regulators, ensuring open communication and effective collaboration.
  • Commercial contract work, including drafting, reviewing, and analyzing agreements and other legal documents, as well as advising on interpretation of existing agreements.
  • Shaping legal relationships through independent contract negotiations and realizing American Express's rights.
  • Legal support for business on marketing initiatives, digital initiatives, and other strategic projects.
  • Examination of legal issues, including fact clarification and development of possible solutions.
  • Primary legal support for acquisitions, strategic alliances, and other major transactions, including legal due diligence and structuring.
  • Support new product development and business re-engineering initiatives.
  • Proactive role in ensuring management and the organization understand and comply with legal and regulatory requirements.
  • Briefing of outside counsel to obtain cost-effective expert legal advice, management of outside counsel, and external legal fees.
  • Represent American Express in courts, negotiations, association meetings, and vis-à-vis authorities and regulators.
  • Legal advice to the main bodies in Germany and Austria, including the Country Executive Team, Risk Committees, and Branch Governance Committee.
  • Lead a team of two lawyers located in Germany and Austria.

Requirements:

  • Fully qualified German lawyer (ideally with two Prädikatsexamen).
  • Substantial practice experience (8+ years) in the payment services or banking sector.
  • Fluent in English and German.
  • Proven record of superior drafting skills.
  • Proven record of understanding commercial implications of legal advice.
  • Proven ability to handle wide variety of work and balance conflicting demands to high levels of client satisfaction.
  • Familiarity with laws relating to credit and charge card, travel, banking, and consumer financial services, as well as regulatory law applicable to banks/payment institutions.
  • Familiarity with project management, particularly in outsourcing and re-engineering projects.
