Im Team “IP Legal, Domains & Licences” sind wir für das strategische und operative Management des Intellectual Property Portfolios des TUI Konzerns verantwortlich. Wir schützen, überwachen und verteidigen weltweit die immateriellen Vermögensgegenstände, insbesondere die Marken
- und Domain-Portfolios des Konzerns.
Dabei vertreten wir unsere Gesellschaften selbst vor nationalen, regionalen und internationalen Ämtern und arbeiten in einem internationalen Umfeld mit vielen Kolleginnen und Kollegen diverser Stakeholder wie Marketing, M&A, Tax, Finance sowie operativer Gesellschaften zusammen. Wir erarbeiten und verhandeln vielfach Verträge im Zusammenhang mit geistigem Eigentum (wie z.B. Lizenzverträge, Koexistenzvereinbarungen, Prior Rights Agreements und Kaufverträge). Weitere Schwerpunkte sind internationale Screening von Konzern
- und Drittrechten, Konzeption und Umsetzung von Lizenzstrategien sowie Online Brand Protection.
ZUR POSITION
Beratung in allen Angelegenheiten auf dem Gebiet des Gewerblichen Rechtsschutzes
Eigenständige Betreuung und Management der Marken
- und Designportfolios von Konzerngesellschaften
Vertretung in und Durchführung von allen relevanten Verfahren vor dem DPMA, BPatG, EUIPO und WIPO sowie Schiedsverfahren (UDRP, ADR etc.)
Rechtliche Unterstützung bei der Entwicklung von neuen Kennzeichen, einschließlich der Beratung zur Schutzfähigkeit, Verfügbarkeit und Einschätzung des Nutzungsrisikos durch die Durchführung rechtlicher Risikoanalysen von Markenrecherchen Betreuung von Schutzversagungsverfahren im Rahmen von nationalen, europäischen und Internationalen Registrierungen
Durchsetzung von Kennzeichenrechten bei Rechtsverletzungen durch Dritte, auch im Internet und in Social Media (u.a. Berechtigungsanfragen, Abmahnungen, Vorbereitung von gerichtlichen Verfahren) in Deutschland sowie im Ausland
Koordinierung von Auslandsvertretern bei IP-Angelegenheiten betreffend Rechte anderer Jurisdiktionen
Markenkollisionsüberwachung
Prüfung, Gestaltung und Verhandlung von Verträgen, insbesondere Lizenz-, Franchise
- und Kooperationsverträgen, Vorrechts
- und Koexistenzvereinbarungen sowie Allowance-Agreements etc.
Entwicklung und Beratung von internationalen Markenrechts
- und Lizenzrechtsstrategien
Beratung auch in urheberrechts
- und wettbewerbsrechtlichen Angelegenheiten
Mitwirkung und Beratung in M&A-Projekten.
ZU IHNEN
Abgeschlossenes 2. juristisches Staatsexamen und Fachanwalt/ -anwältin für gewerblichen Rechtschutz oder vergleichbare Qualifikation (z.B. Patentanwalt/ - anwältin)
Mehrere Jahre Berufserfahrung im gewerblichen Rechtsschutz mit dem Schwerpunkt Markenrecht (Prosecution, Litigation) und Vertragsrecht
Erfahrung in der rechtlichen Beurteilung von Social Media & Plattformen
Fundierte Kenntnisse in den gängigen MS Office Tools und Google sowie Verständnis für Plattform-Strukturen
Verhandlungssichere Englischkenntnisse, weitere Sprachen wie z.B. Französisch oder Spanisch sind ein Plus
Spaß an der Arbeit in einem hochspezialisierten Team
