ROLE OVERVIEW
The Lead Counsel, Compliance and Regulatory Affairs will deliver essential legal guidance on regulations affecting the beauty sector and other compliance-related issues across Wella Company's product range. This role involves advising business units and cross-functional teams on a broad spectrum of legal matters related to beauty law and regulatory compliance in the U.S. and throughout the Americas, including product labeling and marketing claims.
KEY RESPONSIBILITIES
- Provide legal counsel to business units and key cross-functional teams (including R&D, Marketing, and Regulatory Affairs) on a comprehensive range of legal issues within the beauty and cosmetics sector, focusing on:
- Adherence to regulatory frameworks in the U.S. at both federal (e.g., FTC, MOCRA, Federal Food, Drug, and Cosmetic Act, Fair Packaging and Labeling Act) and state levels (e.g., Prop 65), as well as across the Americas, as applicable.
- Compliance with ESG-related claims, including packaging and corporate messaging.
- Understanding and implementing packaging regulations as outlined by FTC guidelines.
- Development and evaluation of product attribute claims and testing protocols; review of marketing claims for hair and nail products.
- Assistance with product quality and recall processes.
- Offer legal advice on regulatory and marketing activities, particularly those intersecting with primary support functions (e.g., regulated label claims, product attribute claims review).
- Collaborate with external legal counsel as needed, particularly regarding compliance with laws in other regions of the Americas.
- Oversee and manage all regulatory, marketing, and labeling-related litigation and industry challenges.
- Monitor and assess regulatory trends and litigation, developing strategic and proactive approaches to communicate with internal stakeholders.
- In partnership with Regulatory, R&D, and Marketing teams, provide guidance in drafting and updating regulatory review policies and procedures.
- Act as the legal liaison for the Communications and ESG team, reviewing all communications materials related to environmental, sustainability, and governance issues.
- Support other members of the Legal department in relevant areas of coverage.
- Engage with government regulatory bodies and administrative agencies on behalf of the company as necessary.
- Participate in relevant trade associations (such as the Personal Care Products Council) to stay informed on industry issues and risks, representing the company at pertinent events.
- Collaborate with business units to develop, implement, and educate on the company's regulatory compliance policies and procedures.
- Consult with all organizational levels, including senior leadership, to identify critical legal issues, evaluate potential legal options, and provide comprehensive analyses and solutions.
- Manage external legal counsel in relevant areas as required.
QUALIFICATIONS
- Licensed attorney in CA or NY (or ability to obtain a license as in-house counsel) with a J.D. from a top-tier law school and outstanding academic credentials.
- A minimum of 10 years of experience in a leading law firm or corporate legal department.
- Significant experience advising on cosmetic regulatory matters, including in litigation contexts.
- Experience in evaluating scientific and technical data to support product safety assessments and claims substantiation.
- Exceptional communication skills (both written and verbal); a strong collaborator capable of working effectively with business partners and colleagues.
- Ability to navigate a complex, matrixed, and geographically diverse environment.
- Strong aptitude for identifying business and legal issues with a practical, business-oriented approach to problem-solving in a dynamic environment.
- Demonstrated strategic and creative thinking to address complex legal challenges.
- Independent, detail-oriented, organized, and efficient with strong follow-through capabilities.
