**Duties**:

- Senior counsel for intelligence law operations and provides expert, authoritative legal advice on intelligence and counterintelligence (CI) activities, Info Ops, CYBER operations, and intelligence oversight.
- Evaluates complex factual issues related to every aspect of USAREUR operations for legal sufficiency to support the command’s desired outcome.
- Conducts comprehensive legal reviews of draft regulations, policy directives and operational concepts and activities.
- Evaluates International Law and treaties, European Law and newly enacted European statutes, proposed Federal legislation, Federal and DoD regulations, and policy statements governing intelligence, CI, IO and CYBER operations.
- Advises all elements of the command on impacts to operational activities.
- Advises the USAREUR Commander, staff and Major Subordinate Commands (MSCs) on responses to Congressional inquiries.
- Provides legal advice to the USARUER Central Personnel Security Clearance Facility related to security clearance adjudication, policy and procedures.
- Advises on USAREUR support of intelligence activities and operations, including CI, HUMINT, SIGINT and OSINT mission support, authority review and analysis.
- Provides legal advice and prepares legal opinions relating to the organization, powers, functions operations and the delegation of those powers and duties to accomplish OSD, HQDA, and USAREUR assigned tasks and missions.
- Senior legal advisor on all matters involving Intelligence Oversight Sensitive Information policy and restrictions, Questionable Intelligence Activities and investigations of significant or highly sensitive matters involving intelligence personnel.
- Drafts all Proper Use Memoranda (PUMs) required for DFII capture, analysis, retention and dissemination and certifies compliance with all Intelligence Oversight policy requirements.
- Facilitates publication and dissemination of all PUMs to ensure all Command personnel involved in DFII capture, analysis, retention and dissemination are fully aware of approvals provided and restrictions imposed on all DFII missions and activities.
- Primary legal advisor for all non-intelligence activities conducted in support of DFII capture, analysis, retention and dissemination in furtherance of USAREUR and EUCOM mission sets.
- Reviews all DFII requests by non-intelligence capabilities or personnel, and for non-intelligence purposes, and certifies compliance with all Sensitive Information policy requirements.
- Advises the command on intelligence-based and non-intelligence based airborne and satellite imagery collection activities involving imagery collection operations in support of USAREUR and foreign humanitarian assistance.
- Evaluates complex factual issues related to every aspect of USAREUR-AF civilian and military operations for legal sufficiency to support the command’s mission.
- Conducts comprehensive legal reviews of draft orders, policy directives, operational concepts and activities in order to provide substantive and procedural advice to the command’s ability to lawfully execute its mission.
- Renders definitive legal opinions and associated oral advice on a variety of issues for including those where no legal precedent exists.

**Conditions of Employment**:

- A two-year trial/probationary period may be required.
- Position requires incumbent to obtain and maintain a determination of eligibility for a Top-Secret security clearance based on a SBI with eligibility for sensitive compartmented information (SCI) for access for the duration of employment.
- This position requires the incumbent to maintain active bar membership, in good standing (as defined by the pertinent bar) of the bar of the highest court of a State, U.S. territory, the District of Columbia, or Commonwealth of Puerto Rico.
- Incumbent is required to sign a DA Form 5019 (Condition of Employment for Certain Positions Identified as Critical under the Drug Abuse Testing Program).
- Position requires incumbent must successfully pass a urinalysis screening for illegal drug use prior to appointment and periodically thereafter.
- Required to maintain open line of communication the USAREUR SJA at all times (issued cellular phone).
- Must obtain and maintain a no-fee passport and associated visa while assigned to a Federal civilian position in an area requiring a passport and associated visa, if authorized
